Terms and Conditions of Use of the Portál IoT Service

1. Introductory Provisions

1.1. These Terms and Conditions govern the rights and obligations between the operator of the Portál IoT service, acting as the provider, and the person using the service as a user.

1.2. The User expresses their consent to these Terms and Conditions by creating an account, logging in to the Service, using the Service, sending data to the Service, or otherwise using the functions of Portál IoT.

1.3. If the User does not agree to these Terms and Conditions, the User is not entitled to use the Service.

2. Description of the Service

2.1. Portál IoT is a web-based service intended for the receipt, storage, display, and basic management of data from IoT devices, in particular through HTTP GET, HTTP POST, and MQTT.

2.2. Within the Service, the User may register sensors, manage their tokens, receive data, create dashboards, and display values, charts, and other visualisations.

2.3. The Service may enable private dashboards, public dashboards, and dashboards shared by invitation.

2.4. The Provider is entitled to modify, extend, restrict, temporarily suspend, or terminate the Service, in particular for reasons of maintenance, security, technical changes, prevention of misuse, or changes to the business model.

3. User Account

3.1. The User is responsible for the accuracy of the information provided during registration.

3.2. The User is responsible for protecting their access credentials, passwords, API tokens, and sensor tokens.

3.3. All actions carried out through the User account or sensor tokens shall be deemed to be actions of the User, unless the User proves otherwise.

3.4. The User is obliged to notify the Provider without undue delay if the User suspects any misuse of the account or token.

4. Data, Sensors, and User Responsibility

4.1. The User is responsible for devices, sensors, firmware, software, configuration, measured values, frequency of data transmission, and the accuracy of data sent to the Service.

4.2. The Provider does not verify the correctness, completeness, accuracy, or security of data sent by the User or by the User's devices.

4.3. The User acknowledges that measured data may be incorrect, delayed, incomplete, lost, corrupted, or temporarily unavailable.

4.4. The User is obliged to configure their devices so that they do not damage the Service, overload the infrastructure, or restrict other users.

4.5. The User must not send to the Service any data that violates legal regulations, the rights of third parties, or the security of the Service.

5. Prohibition of Use for Critical Purposes

5.1. The Portál IoT Service is not intended for use in systems where an outage, error, delay, incorrect value, or loss of data may result in harm to health, danger to life, damage to property, environmental damage, production downtime, an accident, fire, flooding, malfunction of technological equipment, or other serious harm.

5.2. The Service is not intended in particular for the control or security of medical devices, transport systems, critical infrastructure, fire protection systems, alarm systems, industrial automation, energy systems, water management facilities, heating, cooling, pumps, tanks, machines, or other systems requiring guaranteed availability, accuracy, or response time.

5.3. If the User nevertheless uses the Service for any of the above or similar purposes, the User does so solely at the User's own risk and responsibility.

6. Service Availability

6.1. The Service is provided without any guarantee of uninterrupted availability, unless otherwise agreed in writing with a specific User.

6.2. The Provider does not warrant that the Service will be continuously available, error-free, free of security incidents, outages, delays, restrictions, data loss, or other defects.

6.3. The Provider may temporarily restrict or interrupt the Service due to maintenance, updates, failure, a security incident, overload, attack, third-party error, internet outage, supplier outage, or any other technical or operational reason.

6.4. The User acknowledges that the Service depends on internet connectivity, third-party infrastructure, database systems, e-mail services, an MQTT broker, and other technologies whose operation may not be fully under the Provider's control.

7. Backups and Data Loss

7.1. The Provider may perform technical data backups, but is not obliged to guarantee the recoverability of any data, unless expressly agreed otherwise.

7.2. The User is responsible for maintaining their own backups of any data the User considers important.

7.3. The Provider shall not be liable for any loss, corruption, delayed processing, incorrect display, or unavailability of data, unless otherwise provided by applicable legal regulations.

8. Public and Shared Dashboards

8.1. If the User makes a dashboard publicly available or available by invitation, the User is responsible for the data, names, descriptions, units, values, and other information made available thereby.

8.2. The User acknowledges that a public dashboard may be accessible to third parties without any further restriction.

8.3. The User is obliged to ensure that the publication of a dashboard does not violate legal regulations, the rights of third parties, trade secrets, personal data protection, or any other obligations.

9. Prohibited Use

The User must not use the Service in particular for:

9.1. Sending malicious, illegal, fraudulent, or harassing content.

9.2. Attempts to compromise the security of the Service.

9.3. Circumventing Service limits.

9.4. Excessively burdening the Service.

9.5. Obtaining unauthorised access to the accounts, data, or systems of other users.

9.6. Using the Service in a manner that may cause harm to the Provider, other users, or third parties.

10. Restriction, Suspension, and Termination of Account

10.1. The Provider is entitled to restrict, suspend, or cancel an account, sensor, token, dashboard, or other part of the Service if the Provider has reasonable suspicion that the User is violating these Terms and Conditions, legal regulations, the security of the Service, or the rights of third parties.

10.2. The Provider is entitled to restrict or stop receiving data from a device that imposes an unreasonable burden on, or threatens, the Service.

10.3. The User may cancel the account using the options available within the Service or by sending a request to the Provider.

10.4. Upon termination of the account, the User's data may be deleted, unless otherwise agreed or unless legal regulations require a different procedure.

11. Payments and Tariffs

11.1. If the Service is provided free of charge, the User shall not be entitled to any specific level of availability, data retention, support, reimbursement, or compensation.

11.2. If the Service is provided for a fee, the scope of the Service, limits, price, and payment terms shall be governed by the current price list or by an individual agreement.

11.3. The Provider is entitled to change prices, limits, and tariffs. For periods already paid for, such changes shall apply only from the next billing period, unless otherwise specified.

11.4. Failure to pay the price may constitute grounds for restriction, suspension, or termination of the Service.

12. Support

12.1. The Provider may provide technical support according to the Provider's capabilities.

12.2. Unless expressly agreed otherwise, the User shall not be entitled to support within any specific response time or to the resolution of a request by any specific deadline.

13. Disclaimer of Warranties

13.1. The Service is provided as is, in its currently available condition, with possible errors and limitations.

13.2. The Provider gives no warranty that the Service will meet the User's specific needs, or that it will be continuously available, error-free, secure, accurate, up to date, or fit for any particular purpose.

13.3. The Provider gives no warranty as to the correctness of measured data, calculations, charts, dashboards, alerts, alarms, exports, or any other outputs of the Service.

13.4. The User uses the Service at the User's own risk.

14. Limitation of the Provider's Liability

14.1. To the maximum extent permitted by applicable legal regulations, the Provider shall not be liable for any damage, harm, loss, costs, expenses, penalties, or other claims arising in connection with the use of the Service, the inability to use the Service, Service outage, data loss, incorrect data, delayed data, incorrect configuration, error of the User's device, third-party error, or any decision made by the User on the basis of data displayed in the Service.

14.2. In particular, the Provider shall not be liable for:

  • loss or corruption of data,
  • unavailability of the Service,
  • incorrectness or incompleteness of measurements,
  • delayed delivery of data,
  • failure to send, or delayed sending of, a notification,
  • damage to the User's device,
  • damage to property,
  • lost profit,
  • loss of production,
  • operational downtime,
  • loss of customers,
  • loss of goodwill,
  • indirect, consequential, special, or punitive damages,
  • claims asserted by third parties against the User.

14.3. If, notwithstanding the foregoing, the Provider incurs liability towards the User, the total compensation for damage shall be limited, to the maximum extent permitted by applicable legal regulations, to the amount paid by the User to the Provider for use of the Service during the last 12 months preceding the occurrence of the damage.

14.4. In the case of free use of the Service, the Provider's liability is excluded entirely to the maximum extent permitted by applicable legal regulations.

14.5. The limitation of liability shall apply irrespective of the legal basis of the claim, in particular to claims arising from contract, breach of statutory duty, compensation for damage, unjust enrichment, defective performance, or any other legal fact.

14.6. Nothing in these Terms and Conditions excludes or limits the Provider's liability to the extent that such exclusion or limitation is not permitted by legal regulations, in particular liability for harm caused intentionally, by gross negligence, harm to the natural rights of a person, or liability towards a weaker party where such liability cannot be validly limited.

15. User Liability and Third-Party Claims

15.1. The User shall be liable for any and all damage, harm, costs, and claims incurred by the Provider or third parties as a result of a breach of these Terms and Conditions, legal regulations, the rights of third parties, or as a result of incorrect or risky use of the Service.

15.2. If a third party asserts a claim against the Provider in connection with the User's data, devices, dashboards, account, or conduct, the User is obliged to provide the Provider with the necessary cooperation and reimburse the Provider for reasonably incurred costs, to the extent permitted by legal regulations.

16. Personal Data Protection

16.1. The processing of personal data is governed by separate Personal Data Processing Principles.

16.2. The User is responsible for ensuring that the User does not enter into the Service any personal data of third parties without an appropriate legal basis.

16.3. If the User processes personal data of third parties through the Service as a personal data controller, the User is responsible for fulfilling the User's obligations under personal data protection legislation.

17. Amendments to the Terms and Conditions

17.1. The Provider is entitled to amend these Terms and Conditions.

17.2. The current version of the Terms and Conditions shall be available within the Service or on the Provider's website.

17.3. By continuing to use the Service after an amendment becomes effective, the User agrees to such amendment.

17.4. If the User does not agree to an amendment, the User is entitled to stop using the Service and cancel the account.

18. Governing Law and Dispute Resolution

18.1. These Terms and Conditions shall be governed by the laws of the Czech Republic.

18.2. Disputes shall primarily be resolved amicably.

18.3. If a dispute cannot be resolved amicably, it shall be resolved by the competent court of the Czech Republic in accordance with applicable legal regulations.

18.4. If the User is a consumer, this shall be without prejudice to the User's rights that cannot be contractually restricted.

19. Final Provisions

19.1. If any provision of these Terms and Conditions is invalid, ineffective, or unenforceable, this shall not affect the validity of the remaining provisions.

19.2. An invalid or unenforceable provision shall be replaced by a provision that comes as close as possible to it in meaning and purpose and that is legally permissible.

19.3. These Terms and Conditions shall become effective on 1 July 2026.
